1. Acceptance of Terms

By accessing or using the Rated Reviews platform and website at ratedreviews.com.au, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.

These Terms apply to all users of the platform, including business owners, administrators and any individuals accessing the platform on behalf of a business.

These Terms constitute a legally binding agreement between you and Rated Reviews Pty Ltd (ABN 80 169 872 326), 14 Commercial Rd, Kingsgrove NSW 2208, Australia.

2. Our Services

Rated Reviews provides a review management platform that enables Australian businesses to:

  • Send review requests to customers via SMS, email and WhatsApp
  • Collect and aggregate reviews from multiple online platforms
  • Generate and manage AI-powered review responses
  • Monitor Google Business Profile performance insights
  • Use our Review Capture Program to manage customer feedback privately
  • Collect video testimonials from customers

We reserve the right to modify, suspend or discontinue any part of our services at any time with reasonable notice where possible.

3. Account Registration

To use our platform you must create an account. You agree to:

  • Provide accurate, current and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and not share it with third parties
  • Notify us immediately of any unauthorised use of your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years old and have the legal authority to bind a business to these Terms if registering on behalf of a company.

4. Subscriptions & Billing

Plans and pricing

Our platform is available on monthly and annual subscription plans as detailed on our Pricing page. All prices are in Australian Dollars (AUD) and include GST where applicable.

Payment processing

Payments are processed securely by Stripe. By providing your payment details, you authorise us to charge your nominated payment method on a recurring basis according to your selected plan.

Renewals and cancellations

  • Subscriptions renew automatically at the end of each billing period unless cancelled
  • You may cancel your subscription at any time from your account settings
  • Cancellations take effect at the end of the current billing period — you retain access until then
  • We do not provide refunds for partial billing periods

Price changes

We may change subscription prices with at least 30 days' notice. Continued use of the platform after a price change takes effect constitutes acceptance of the new pricing.

5. Free Trial

We offer a 14-day free trial for new accounts. During the trial:

  • No credit card is required to start
  • You have access to the features of your selected plan
  • If you choose to subscribe at the end of the trial, your billing commences on the day you add payment details
  • If you do not subscribe, your account will be deactivated at the end of the trial period

Free trials are available once per business. We reserve the right to modify or discontinue free trial offers at any time.

6. Acceptable Use

You agree not to use our platform to:

  • Send unsolicited messages (spam) to people who have not consented to receive communications from your business
  • Violate the Australian Spam Act 2003 or any other applicable laws
  • Solicit, post or incentivise fake or fraudulent reviews
  • Harass, threaten or intimidate customers or reviewers
  • Impersonate any person or entity
  • Attempt to reverse engineer, hack or disrupt our platform
  • Use the platform in any way that could damage our reputation or the reputation of review platforms we integrate with

Violation of these terms may result in immediate suspension or termination of your account without refund.

7. Your Content

You retain ownership of all content you upload to the platform, including your customer contact lists, business information and any customisations you make to review request templates.

By using our platform, you grant Rated Reviews a limited licence to use, store and process your content solely for the purpose of providing our services to you.

You are responsible for ensuring you have the legal right to upload and use any customer data, including having obtained appropriate consent for marketing and review request communications under applicable Australian privacy and spam laws.

8. Review Platform Compliance

Our platform integrates with third-party review platforms including Google, Facebook and others. You agree to comply with the terms of service of any platform you connect to through Rated Reviews.

Our Review Capture Program is designed to give businesses the opportunity to address customer concerns privately before they are posted publicly. It does not delete, suppress or manipulate reviews, and is intended to comply with Google's review policies. You are responsible for using this feature in a manner consistent with applicable platform terms.

Rated Reviews does not guarantee any specific review outcomes, Google rankings or business results. Results will vary depending on your business, industry and how you use the platform.

9. Intellectual Property

All intellectual property in the Rated Reviews platform, including software, design, logos, copy and AI models, is owned by or licensed to Rated Reviews Pty Ltd. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use our services.

You may not copy, reproduce, distribute, modify or create derivative works from any part of our platform without our express written permission.

10. Privacy

Your use of our platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

11. Disclaimers

Our platform is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the platform will be uninterrupted, error-free or free of viruses. We are not responsible for the accuracy, completeness or legality of reviews collected from third-party platforms.

12. Limitation of Liability

To the maximum extent permitted by Australian law, Rated Reviews will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data or goodwill, arising from your use of or inability to use our services.

Our total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

13. Termination

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

We may suspend or terminate your account immediately, without notice or refund, if we determine you have violated these Terms or are using the platform in a way that is harmful to other users, third parties or our business.

Upon termination, your right to access the platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

15. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via a notice on our platform at least 14 days before the changes take effect. Your continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
